MERRILL – An Irma man remains in the custody of the Lincoln County Jail on $50,000 cash bond in the wake of a January incident during which he reportedly had sexual contact with an unconscious person.
According to a criminal complaint filed with the Lincoln County District Attorney’s Office, a Lincoln County Sheriff’s Deputy met with a party who indicated having resided with Marvin W. Loka, 55, of Irma. The victim further described having fallen into a deep sleep on the evening of Thursday, Jan 20. after consuming alcohol and other substances.
The victim advised after waking up on the morning of Jan. 21, Loka apologized for having sexual contact with the victim while the victim was asleep.
The victim advised he was not in a relationship with Loka nor had consented to the contact. The victim advised the investigating deputy he had been allowing Loka to stay at his residence. Upon the deputy confronting Loka with a recording the victim had made of Loka admitting to the offense, Loka admitted to having sexual contact with the victim while the victim was passed out.
Loka made his initial appearance in Lincoln County Circuit Court on Friday, Feb. 21, facing a felony charge of 2nd degree sexual assault of an unconscious victim, with a modifier of lifetime supervision of serious sex offenders. During that hearing, a $50,000 cash bond was ordered, as well as Loka to not have contact with the victim in the case.
Loka was back in court on Monday, March 2 for a preliminary hearing, during which he entered a plea of not guilty. Following the hearing, a Lincoln County judge found probable cause to send the case to trial. Loka is due back in court on Thursday, April 2 for a pre-trial scheduling conference.
